Scope and Acceptance

These Terms of Service ("Terms") govern your use of the Diffract platform ("Service"), operated by Théo Fourcat, auto-entrepreneur, SIRET 921 112 462 00012, Lyon, France ("we", "us"). By creating an account or using the Service, you accept these Terms in full. If you do not agree, do not use the Service.

Service Description

Diffract is an AI-assisted marketing platform that helps brands create, manage, and publish content to social media. The Service uses artificial intelligence to generate text, images, and videos based on your instructions and brand identity. The Service currently operates as a closed beta with limited access.

Your Account

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 16 years old to use the Service. One person or legal entity per account,shared credentials are not permitted.

AI-Generated Content

You retain ownership of content you create using the Service, to the extent permitted by the underlying AI providers (Google, OpenAI, and others). We do not claim ownership of your generated content. You grant us a limited license to store, process, and display your content solely to operate the Service.

You are solely responsible for reviewing, verifying, and approving all AI-generated content before publishing. AI outputs may contain inaccuracies, inappropriate material, or content that infringes third-party rights. You must not publish content without reviewing it first.

We do not guarantee that AI-generated content is accurate, original, non-infringing, or suitable for any particular purpose. The AI is a tool,you are the publisher.

Social Media Publishing

When you connect a social media account and publish content through the Service, you authorize us to act on your behalf via the platform's API. You remain responsible for all content published to your accounts. You must comply with each platform's terms of service and community guidelines. We may suspend publishing capabilities if we detect violations.

Prohibited Uses

You may not use the Service to:

• Generate or publish illegal, defamatory, harassing, or discriminatory content
• Create spam, misleading content, or engage in deceptive practices
• Impersonate individuals, brands, or organizations
• Generate content that infringes intellectual property rights knowingly
• Attempt to reverse-engineer, overload, or interfere with the Service
• Share account credentials or resell access to the Service

Intellectual Property

The Service itself,its code, design, brand, documentation, and AI models,is our property or licensed to us. Your use of the Service does not grant you any rights to our intellectual property. Your brand assets (logos, images, text) remain yours.

Service Availability

We strive to keep the Service available but provide no uptime guarantee. The Service may be interrupted for maintenance, updates, or circumstances beyond our control. AI generation features depend on third-party providers (Google, OpenAI) whose availability we do not control.

Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. This includes but is not limited to: loss of revenue, reputation damage from published content, social media account restrictions, or data loss. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or 100 euros, whichever is greater.

Account Termination

You may delete your account at any time from your dashboard. We may suspend or terminate your account if you violate these Terms, engage in prohibited uses, or if required by law. Upon termination, your data is handled according to our Privacy Policy,personal data is permanently deleted within 30 days.

Applicable Law and Jurisdiction

These Terms are governed by French law. Any dispute arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of Lyon, France, after an attempt at amicable resolution.

Changes to These Terms

We may update these Terms at any time. Significant changes will be communicated via email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
